These Terms of Service constitute a legally binding agreement between you and MoodyWatch regarding your access and use of the MoodyWatch application.

By downloading, installing, or using this application, you indicate that you have read, understood, and agree to be bound by these terms.

If you do not agree to these terms, please do not download, install, or use this application.

1. Application Description

MoodyWatch is designed for Apple Watch users to monitor and analyze heart rate variability (HRV) and stress levels. This application does not provide any medical diagnosis, treatment, or advice, and is intended for general health and wellness purposes only.

This application is not designed to comply with healthcare-related regulations (such as HIPAA or FISMA).

2. Scope of License

2.1 License Grant

We grant you a non-exclusive, non-transferable, limited license to install and use one copy of this application on one Apple-branded device that you own or control.

2.2 Restrictions

You may not:

  • Share, distribute, rent, lend, sublicense, sell, or transfer this application
  • Reverse engineer, decompile, or attempt to extract the source code
  • Modify or create derivative works based on this application
  • Remove any copyright, trademark, or proprietary notices

3. Technical Requirements

This application requires Apple Watch and iPhone running iOS 14.0 or higher. You are responsible for ensuring your device meets the technical requirements.

4. Maintenance and Support

Apple has no obligation to provide any maintenance or support services for this application.

5. Use of Data

Your use of this application is subject to the MoodyWatch Privacy Policy. We do not collect personal health data. All stress analysis and HRV calculations are performed locally on your device.

6. Liability Limitations

The Licensor shall not be liable for:

  • Device malfunctions, data loss, or application errors
  • Indirect, special, incidental, or consequential damages
  • Any medical-related issues, as this application does not replace professional medical advice

7. Warranty Disclaimer

This application is provided "as is" without any express or implied warranties. We do not guarantee that the application will be free of errors or interruptions.

8. Subscriptions & Payments

MoodyWatch can be downloaded for free. We offer premium subscription services (MoodyWatch Pro) to unlock additional features.

  • Payments are processed through Apple's in-app purchase system
  • Subscriptions automatically renew unless cancelled 24 hours before renewal
  • Subscription management can be done in iTunes account settings
  • No refunds for unused portions of subscriptions

9. Termination

This license remains in effect until termination. We may terminate this Agreement if you violate any terms. After termination, you must stop using and uninstall this application.

10. Intellectual Property

MoodyWatch and its related logos, trademarks, and intellectual property are owned by us. You may not use the above content without our written consent.

11. Applicable Law

This Agreement shall be governed by the laws of the People's Republic of China. Any dispute shall be resolved through friendly negotiation or filed with the competent court in Shanghai.

12. Changes to This Agreement

We reserve the right to modify these terms at any time. Your continued use after changes indicates acceptance of the updated terms.
